We, MVALUE TRADING SDN BHD (Company Registration No. 202101037019 (1437319-K) (“Company”, “we”, “our” or “us”) are the legal and registered owner of the mobile application known as MValue (“Mobile Apps”).

During the course of your relationship, services, dealings, transactions, communications and/or usage of our Mobile Apps, there will be instances and circumstances where you will provide certain Personal Data (as defined below) to us or will be required to provide those Personal Data to us in order for us to perform certain actions and/or services to you.

We value and are always committed to protect your Personal Data and therefore, have created this data privacy notice ("Privacy Notice") to explain about our collection, processing, storage, retention and disclosure of Personal Data pursuant to the Personal Data Protection Act 2010.

Kindly note that this Privacy Notice is subject to changes, revisions, modifications, amendments and/or variation from time to time and therefore, we hereby reserve our rights and entitlements to change, revise, modify, amend and/or vary this Privacy Notice at any time. The most current version of our Privacy Notice will always be made available on our Mobile Apps.

Therefore, we always encourage all our users to always check and read our latest Privacy Notice on our Mobile Apps before you submit any Personal Data to us.

Full Consent and Authorisation

Except as otherwise provided in this Privacy Notice, we only collect the Personal Data that you have provided to us. If you prefer that we do not collect any Personal Data from you, please do not provide us with any such information and Personal Data.

However, in these circumstances, kindly let us know of your concerns and we will attempt our best to resolve any concerns that you may have in regard to this Privacy Notice. We also encourage and suggest that you do not visit and stop any browsing, using and/or accessing our Mobile Apps accordingly.

As for our agents, vendors, suppliers, distributors, authorized representatives, service providers, contractors, authorized representatives and/or merchants, you can opt not to continue any dealings, transactions, relationship, communications and/or interactions with us if you are not comfortable or agreeable with our Privacy Notice

At any time, you may withdraw your consent to our processing and management of your Personal Data as set out in this Privacy Notice by contacting us via the contact detail provided in this Privacy Notice.

If we do not receive any notification from you concerning our processing and management of your Personal Data, we will regard and assume that you are always (at all times) in full agreement to the terms of this Privacy Notice and we shall continue to process and manage your Personal Data pursuant to this Privacy Notice.

Usage & Applicability of this Privacy Notice

This Privacy Notice will apply and is binding to:

  1. all customers, users and/or members of the Mobile Apps;
  2. all agents, vendors, suppliers, distributors, authorized representatives, service providers, contractors and/or merchants of the Mobile Apps (and the services provided therein); and/or
  3. any other person whomsoever who is related and/or connected to our Mobile Apps (and the services provided therein).

Definition and Meaning of Personal Data

For purposes of this Privacy Notice, Personal Data is defined as any data, information and/or details which are able to identify you or belongs to you and Personal Data usually include, but is not limited to, the following:

  1. name & nationality;
  2. national registration identification card number or passport number & details;
  3. photograph;
  4. e-mail address, delivery address, your location and/or postal address;
  5. age, sex, gender and marital status;
  6. religion and ethnic origin;
  7. telephone number, mobile number and/or fax number;
  8. payment related details (such as credit card details, bank account details, debit card details and/or loyalty card details);
  9. family related details (such as information relating to household members, spouse, parents, siblings, children, relatives and any other family members);
  10. emergency contact details;
  11. social media account details;
  12. personal interests, hobbies and/or preferences;
  13. personal and political opinions, religious beliefs and/or any other beliefs of similar nature;
  14. commission or alleged commission of any offences (including road traffic offences);
  15. any details relating to any other person(s) or party(ies) who may be identified from the information, data or document submitted to us;
  16. insurance policies details;
  17. details of any crimes or offences (including road traffic offences); and/or
  18. any other personal data and/or information which is provided to us in the course of your dealings, transactions, relationship and/or communications with us through our Mobile Apps,

(collectively defined and referred to as "Personal Data").

Personal Data of Minor/Under-Age

If you are considered as a minor (under the age of 18 years old) in Malaysia, please do not submit any Personal Data to us, unless it is with the full knowledge, consent and agreement of your parent and/or legal guardian.

Therefore, if we are being provided by any Personal Data of a minor, then it is our rights and entitlements to assume that those Personal Data of the minor is provided to us upon obtaining consent and/or authorisation from their parent and/or legal guardian. Those Personal Data of the minor shall then be bound by this Privacy Notice.

At all times, we shall also be fully indemnified by the person who provided the Personal Data of the minor to us and excluded against any claims, liabilities and/or responsibilities whatsoever in regard to the Personal Data of the minor.

Personal Data of Other Individual/ Third Party

In circumstances that you provide Personal Data of other individuals or a third party to us, you hereby confirm and agree to us that you have obtained the consent from the third party(ies) or person(s) whose personal data may be given to us by you or identified from your Personal Data which may be processed and managed by us for the “Purposes” (as defined below) as set out in this Privacy Notice.

At all times, we shall also be fully indemnified and excluded against any claims, liabilities and/or responsibilities whatsoever in regard to the Personal Data of other individual/third party.

How We Collect Your Personal Data

Generally, your Personal Data are provided and/or collected by us during the following circumstances (non-exhaustive):

  1. when you visit and browse our Mobile Apps whereby you will be required to register as a user or member of our Mobile Apps;
  2. when you communicate with us (especially when you enquire about our company, business, trading, employees, products, the Mobile Apps and/or the services therein etc.);
  3. when you enter into any relationship, business, transaction, trading, contract, engagement, appointment and/or dealing with us;
  4. when you participate in any of our business, trading, marketing, services or promotional events, contest and/or promotions;
  5. from publicly available sources;
  6. when you download, install, use, browse and access our Mobile Apps;
  7. when you make an order, purchase and/or when making payment on our Mobile Apps;
  8. when we communicate with you (for whatsoever purposes);
  9. when we provide any business, goods or services to you or vice versa;
  10. when you provide us with any feedback, review or complaint whatsoever;
  11. when you interact with us on our Mobile Apps and/or on social media pages
  12. from third parties;
  13. when we perform certain verification and background checking on you;
  14. filling up any surveys and/or forms on our Mobile Apps; and/or
  15. any other circumstances as required under the laws of Malaysia.

Use of Cookies, Beacons and Similar Technologies on the Mobile Apps

When you are downloading, installing, browsing, using, purchasing, subscribing, interacting, communicating and/or viewing our Mobile Apps, we (or any of our service providers) may use cookies, beacons, tracking systems and other similar technologies for collecting and storing certain information and Personal Data to help us to provide you with a better, faster and safer Mobile Apps browsing and using experience.

The certain information and Personal Data collected by us (or our service providers) may recognise you as a visitor, potential customer, members etc. and may collect information such as how you arrived at the Mobile Apps, the type of browser you are using, the type of operating system you are using, your IP address, your click stream information and time stamp (for example, which section or link on the Mobile Apps that you have viewed, the time the pages were accessed and the time spent per page etc.)

The use of cookies, beacons, tracking systems and similar technologies by us (or our service providers) on the Mobile Apps has different functions. They are either necessary for the functioning of the Mobile Apps, to help us to improve our performance, or to provide you with extra functionalities. It may also be used to deliver content that is more relevant to you and your interests, or to target advertising to you on or off our Mobile Apps.

How We Use Your Personal Data

We may use your Personal Data in a number of ways, including, but not limited to, for the following purposes:

  1. for our dealings, transactions, relationship, communications and/or interactions related matters;
  2. so that we will be able to provide our best customer care and service to you;
  3. to enhance our customer satisfaction, including but not limited to, resolving complaints, dealing with and/or responding to requests, demands, feedbacks and enquiries, warranties, returns and other after sales services;
  4. to manage and maintain our relationship (business, commercial and/or employment) with you;
  5. keeping you informed of our businesses, trades, products and/or services;
  6. keeping you well informed of our business promotions, discounts, and/or events;
  7. for our internal record keeping;
  8. for our administrative and verification purposes;

  10. for our information, management and security purposes, including, but not limited to, managing and administrating e-mail, handling and investigating any security related issue, vulnerability, and/or incidents whatsoever;

  13. for any purpose incidental, ancillary or in furtherance to the abovementioned purposes,

(collectively defined and referred to as "Purposes").

Disclosure to Third Parties

  1. If and when necessary, in connection with the above Purposes, kindly be informed that your Personal Data may be disclosed and/or transferred to a third party, including but not limited to:
  2. within our “Group of Companies” and organisation (including our associate companies and subsidiaries, as applicable);
  3. our affiliates;
  4. our employees, authorised agents, suppliers, vendors, merchants, service providers, contractors and any person or party who has dealings with us;
  5. our professional advisors (such as tax consultant, accountant, auditors, lawyers and any other external professionals engaged by us for our business);

  7. our business partners, affiliates, related bodies and/or collaborators (usually for them to market and promote their promotions, products and/or services to you accordingly);
  8. to the court (as and when being instructed to do so); and/or

Security of Personal Data

At all times, we are committed to maintain appropriate and reasonable technical and organizational security measures to protect the security of the Personal Data against any loss, misuse, unauthorized access, disclosure or alteration.

Accessing and Updating Your Personal Data

Under the Personal Data Protection Act 2010, you have the right of access to your Personal Data and you may request that we correct any of your Personal Data which is inaccurate, incomplete or outdated.

We may also exercise our discretion in allowing the corrections requested and/or may require further documentary evidence of the new data to avoid fraud and inaccuracy.

Please note that notwithstanding the withdrawal of your consent, we may still process your Personal Data under circumstances that are permitted under the laws of Malaysia, as applicable.

Exclusion of Liability

Please note that we may not be able to continue and/or provide you with our best services, goods, business dealings, relationship, transactions, communications, employment and/or interaction whatsoever if you do not provide us with your consent or withdraw your consent for our processing and management of your Personal Data pursuant to this Privacy Notice.

In these circumstances, we shall not be held liable howsoever for whatsoever issues, claims, liability, responsibilities, problems and/or disputes in regard to our services and/or dealings with you especially in relation to the Mobile Apps (and our services).

Notwithstanding any other provisions in this Privacy Notice, you may opt out of or unsubscribe from receiving any of our promotional materials by contacting us via the contact detail provided in this Privacy Notice.

Third-Party Mobile Application and Websites

Our Mobile Apps may contain links to other website, blogs, social media pages or applications operated by third parties (“Third-Party Sites”). Kindly note that we are not in way howsoever responsible for the personal data protection practices of that Third-Party Sites.

Further, as applicable, from time to time, perhaps some of the Third-Party Sites may be co-branded with our logo or trade mark, even though they are not operated or maintained by us. Kindly check the applicable data privacy policy of the Third-Party Sites to determine how they will handle any information they collect from you.

Duration We Will Keep Your Personal Data

Your Personal Data will be kept and retained by us for as long as necessary, to be determined by us, solely for the Purposes only (as defined above).

Further, our retention of your Personal Data will also always follow the provisions allowed under the Personal Data Protection Act 2010. Rest assured that we will dispose and/or delete your Personal Data if it is no longer needed for the Purposes.

Transfer of Personal Data Out of Malaysia

Please be informed that depending on circumstances, your Personal Data may also be transferred and/or transmitted to another country and is not just confined to usage within Malaysia only.

Nevertheless, rest assured that any transfer of your Personal Data out of Malaysia will always be in full compliance with all laws and regulations in that receiving country. On best endeavour basis, we will always ensure that your Personal Data is dealt with appropriately and securely in that receiving country too.

Governing Laws & Dispute Resolution

This Privacy Notice will follow the provisions of the laws of Malaysia especially the Personal Data Protection Act 2010.

Take Notice that any dispute in regard to this Privacy Notice shall be resolved via good-faith discussion first between all parties concerned.

If an amicable solution cannot be achieved, then all parties concerned shall refer the disputes to the courts of Malaysia and will be subject to the jurisdiction of the said courts.

At all times, we reserve all rights and discretion to initiate any actions against any users or members who violate the Mobile Apps and/or this Privacy Notice (including, but not limited to, legal action and lodging of reports with the relevant authorities including the police).

English Version to Always Prevail

In circumstances that this Privacy Notice is translated to any other languages and there’s confusion, conflict, ambiguity, uncertainty and/or dispute on of the clauses herein, the Parties hereby agree that the English Version of this Privacy Notice shall always prevail over any other languages’ version of this Privacy Notice, as applicable.

Kami MVALUE TRADING SDN BHD (Nombor Pendaftaran Syarikat 202101037019 (1437319-K) (“kita” atau “kami”) adalah pemilik sah dan berdaftar aplikasi telefon pintar atau telefon bimbit yang dikenali sebagai MValue (“Aplikasi Telefon”).

Melalui perhubungan, perkhidmatan, transaksi, komunikasi dan/atau penggunaan Aplikasi Telefon kami, akan ada ketika yang mana para pengguna akan memberikan atau akan diminta untuk memberikan Data Peribadi (seperti yang didefinisikan di bawah ini) kepada kami antara lain, supaya kami dapat memberikan perkhidmatan kami yang baik kepada anda.

Kami sentiasa menghargai dan komited dalam melindungi Data Peribadi anda dan kesemua pengguna Aplikasi Telefon kami. Oleh itu, Notis privasi ini ("Notis Privasi") dicipta untuk memberikan penerangan kepada anda tentang pengutipan, pemprosesan, penyimpanan, pengekalan dan pendedahan Data Peribadi anda sebagaimana yang diperuntukkan di bawah Akta Perlindungan Data Peribadi 2010.

Sila ambil perhatian bahawa kami merizabkan hak untuk menukar, meminda dan/atau mengubah apa-apa terma di dalam Notis Privasi ini pada bila-bila masa. Versi terkini Notis Privasi ini akan sentiasa dimuatnaik dan disediakan di Aplikasi Telefon kami.

Sila periksa kandungan Notis Privasi ini di Aplikasi Telefon kami dari masa ke semasa, terutamanya sebelum anda menyerahkan atau memberikan sebarang Data Peribadi anda kepada kami.

Kebenaran Penuh

Dengan memberikan Data Peribadi anda kepada kami, dengan ini adalah dipersetujui bahawa anda telah memberikan kebenaran, kelulusan, permisi, hak dan persetujuan penuh kepada kami untuk mengunakan Data Peribadi anda selaras dengan terma-terma yang termaktub di dalam Notis Privasi ini.

Selain itu, dengan melawat, menggunakan dan melayari Aplikasi Telefon kami, berhubung, membuat transaksi, komunikasi dan/atau interaksi dengan kami yang mana anda akan memberikan Data Peribadi anda kepada kami, dengan ini adalah disahkan bahawa anda telah membaca kesemua terma-terma di dalam Notis Privasi ini dan memberikan kebenaran, kelulusan, permisi, hak dan persetujuan penuh kepada kami untuk mengunakan Data Peribadi anda selaras dengan terma-terma yang termaktub di dalam Notis Privasi ini dan anda bersetuju untuk terikat dengan terma-terma di dalam Notis Privasi ini pada setiap masa.

Penarikan Kebenaran dan Pilihan-Keluar (Opt-Out)

Kecuali jika diperuntukkan selainnya dalam Notis Privasi ini, kami hanya mengumpul Data Peribadi yang anda berikan kepada kami.

Jika anda tidak bersetuju untuk Data Peribadi anda dikumpul oleh kami, sila jangan memberikan maklumat anda kepada kami atau mengakses Aplikasi Telefon kami.

Seterusnya, anda juga boleh memilih untuk tidak berurusan, membuat transaksi, berhubung, berkomunikasi ataupun berinteraksi dengan kami jika anda tidak bersetuju dengan terma-terma di dalam Notis Privasi ini.

Dengan melawat Aplikasi Telefon kami, berurusan, membuat transaksi, berhubung, berkomunikasi ataupun jika anda berinteraksi dengan kami, anda akan dianggap telah membaca dan memberikan persetujuan penuh kepada kami untuk memproses Data Peribadi anda melalui cara yang dinyatakan dalam Notis Privasi ini.

Anda boleh menarik balik persetujuan anda terhadap pemprosesan Data Peribadi anda untuk Tujuan (seperti yang didefinisikan di bawah), pada bila-bila masa dengan menghubungi kami seperti yang diperuntukkan di dalam Notis Privasi ini. Ini termasuklah kepada kesemua ejen-ejen, pembekal, pengedar, penyedia perkhidmatan, kontraktor dan mana-mana syarikat atau orang yang berkaitan dengan Aplikasi Telefon (atau perkidmatan di Aplikasi Telefon kami).

Jika kami tidak menerima apa-apa notifikasi daripada anda mengenai pemprosesan Data Peribadi anda, kami akan terus memproses Data Peribadi tersebut untuk Tujuan sebagaimana dinyatakan di bawah ini, atas dasar bahawa anda teleh memberikan persetujuan semasa dan terdahulu untuk pemprosesan Data Peribadi anda menurut Notis Privasi ini.

Pihak Yang Berkenaan dengan Notis Privasi Ini

Notis Privasi ini adalah berkenaan, terpakai dan berwajib kepada:

  1. kesemua pelanggan, pengguna dan ahli-ahli Aplikasi Telefon kami;
  2. kesemua ejen-ejen, pembekal, pengedar, penyedia perkhidmatan dan kontraktor kami; dan/atau
  3. mana-mana orang atau pihak yang berkaitan dengan Aplikasi Telefon (atau perkidmatan di Aplikasi Telefon kami).

Definisi Data Peribadi

Bagi tujuan Notis Privasi ini, Data Peribadi anda adalah didefinisikan sebagai butiran peribadi, maklumat, dokumen dan informasi peribadi anda dan ianya (tidak terhad) seperti berikut:

  1. nama dan warganegara;
  2. nombor kad pengenalan atau maklumat paspot;
  3. gambar;
  4. e-mel, lokasi anda dan alamat surat menyurat;
  5. umur, jantina dan status perkahwinan;
  6. agama dan bangsa;
  7. nombor telefon, nombor telefon bimbit dan nombor faks;
  8. butiran dan maklumat pembayaran (seperti nombor kad kredit, akaun bank, kad debit dan/atau kad kesetiaan);
  9. maklumat insurans;
  10. maklumat keluarga (seperti maklumat berkaitan dengan suami, isteri, ibu bapa, adik-beradik, anak, saudara dan atau mana-mana ahli keluarga yang lain);
  11. maklumat hubungan kecemasan dan/atau perujuk;
  12. kepentingan peribadi, hobi dan/atau kesukaan peribadi;
  13. kepakaran, bahasa, kelayakan dan pencapaian akademik;
  14. maklumat akaun media sosial;
  15. pandangan politik, kepercayaan agama dan lain-lain pandangan atau kepercayaan;
  16. rekod kesalahan atau jenayah lampau;
  17. butiran lain yang berkaitan dengan individu lain yang mungkin dikenal pasti dari maklumat, data atau dokumen yang anda berikan kepada kami; dan/atau
  18. sebarang maklumat peribadi lain yang anda berikan kepada kami semasa anda berurusan, membuat transaksi, berhubung, berkomunikasi ataupun berinteraksi dengan kami,

(secara kolektif dirujuk sebagai "Data Peribadi").

Data Peribadi Individu Bawah Umur

Jika anda adalah individu bawah umur 18 tahun di Malaysia, sila jangan bekalkan apa apa Data Peribadi anda kepada kami kecuali dengan kebenaran dan pengetahuan ibu bapa dan/atau penjaga anda.

Oleh itu, jika kami dibekalkan dengan Data Peribadi individu bawah umur, kami akan anggap bahawa individu bawah umur tersebut telahpun mendapatkan kebenaran dan persetujuan penuh daripada ibu bapa dan/atau penjaganya. Apa-apa Data Peribadi individu bawah umur tersebut akan tertakluk kepada Notis Privasi ini.

Pada setiap masa, kami adalah dikecualikan (oleh individu yang membekalkan Data Peribadi individu bawah umur tersebut kepada kami) dan diketepikan daripada apa-apa tuntutan, liabiliti dan/atau tanggungjawab apa-apa ke atas Data Peribadi individu bawah umur tersebut.

Data Peribadi Pihak Ketiga

Jika dan di mana, anda memberikan kepada kami apa-apa Data Peribadi pihak ketiga, anda bersetuju bahawa anda hendaklah dan telah memastikan bahawa pihak ketiga tersebut telah memberi persetujuan penuh kepada anda untuk memberikan Data Peribadi pihak ketiga tersebut dan ianya akan tertakluk kepada kesemua terma-terma di bawah Notis Privasi ini.

Pada setiap masa, kami adalah dikecualikan dan diketepikan daripada apa-apa tuntutan, liabiliti dan/atau tanggungjawab apa-apa ke atas Data Peribadi pihak ketiga tersebut.

Pengumpulan Data Peribadi

Secara amnya, kami mengumpul Data Peribadi seperti berikut (tidak terhad):

  1. apabila anda membuat pertanyaan atau berkomunikasi dengan kami (seperti apabila anda bertanya tentang syarikat, pekerja, produk dan/atau perkhidmatan kami);
  2. apabila anda berurusan, membuat kontrak, transaksi, berhubung, berkomunikasi ataupun berinteraksi dengan kami;
  3. apabila anda mengambil bahagian dalam acara perniagaan dan promosi kami;
  4. dari sumber umum sedia ada;
  5. apabila anda mengakses Aplikasi Telefon kami;
  6. apabila anda berkomunikasi dengan kami (untuk apa-apa tujuan);
  7. apabila kami memberikan sebarang perkhidmatan atau membekalkan sebarang barangan atau produk kepada anda dan sebaliknya;
  8. apabila anda membuat sebarang maklumbalas, ulasan, aduan dan lain-lain pertanyaan kepada kami; dan/atau
  9. dari pihak ketiga.

Penggunaan Cookies, Web Beacons dan Teknologi

Semasa anda memuat-turun, melawat, menggunakan, membeli, membuat transaksi, mendaftar, berinteraksi dan/atau berkomunikasi di Aplikasi Telefon kami, pihak kami (dan pihak syarikat perkhidmatan kami) mungkin akan menggunakan cookies, web beacons dan juga apa-apa teknologi berkaitan untuk mengumpul dan menyimpan infomasi dan Data Peribadi anda, antara lain, bagi tujuan memberikan kepada anda suatu pengalaman penggunaan Aplikasi Telefon kami yang lebih lancar dan baik.

Infomasi dan Data Peribadi anda yang dikumpul oleh kami (dan pihak syarikat perkhidmatan kami) akan mengenal pasti anda sebagai pelawat, bakal pelanggan, ahli dan sebagainya dan kami akan mengumpul informasi daripada anda seperti bagaimana anda sampai ke Aplikasi Telefon kami, jenis “browser” yang anda gunakan, alamat IP anda, maklumat lawatan dan klik anda dan waktu lawatan (contohnya bahagian atau sektor mana yang anda lawatan semasa berada di dalam Aplikasi Telefon kami).

Penggunaan cookies, web beacons dan teknologi berkaitan oleh kami (dan pihak syarikat perkhidmatan kami) di dalam Aplikasi Telefon kami mempunyai beberapa fungsi. Ianya adalah perlu untuk kelangsungan penggunaan Aplikasi Telefon kami, untuk membantu kami untuk menambah-baik perkhidmatan kami atau untuk memberikan lebih fungsi dan mutu perkhidmatan kepada anda. Ianya juga mungkin akan digunakan untuk memberikan isi kandungan yang lebih sesuai, cenderung dan relevan kepada anda dan minat anda di dalam Aplikasi Telefon kami.

Tujuan

  1. untuk urusan perniagaan, kontrak, transaksi, hubungan, komunikasi atau pun jika anda berinteraksi dengan kami;
  2. bagi memberikan dan menyediakan khidmat layanan pelanggan dan perkhidmatan yang terbaik;
  3. untuk meningkatkan kepuasan perkhidmatan pelanggan (termasuklah untuk, tetapi tidak terhad kepada menyelesaikan aduan, mengurus dan/atau membalas permintaan dan pertanyaan, jaminan, pulangan dan perkhidmatan selepas jualan dan apa-apa perkara lain yang berkaitan);
  4. untuk menguruskan dan mengekalkan hubungan kami dengan anda (untuk tujuan perniagaan, komersial dan perkerjaan);
  5. untuk memaklumkan anda mengenai perniagaan, produk dan/atau perkhidmatan kami;
  6. untuk memaklumkan tentang promosi, diskaun dan/atau sebarang acara;
  7. untuk penyimpanan rekod dalaman atau tujuan pentadbiran lain
  8. untuk hal ehwal pentadbiran;
  9. untuk tujuan analisis statistik;
  10. untuk pengurusan maklumat dan tujuan keselamatan, termasuk tetapi tidak terhad kepada pengurusan dan pentadbiran e-mel, pengendalian dan penyiasatan sebarang isu berkaitan keselamatan, kerentanan (exposure) dan/atau insiden;
  11. untuk penstrukturan syarikat, pengabunggan syarikat, pengambil-alihan syarikat, hal-ehwal korporat dan/atau penambah-baikan perniagaan syarikat
  12. untuk hal undang-undang, audit dan/atau apa-apa siasatan; dan/atau
  13. bagi apa-apa tujuan bersampingan dalam penerusan tujuan yang tersebut di atas,

(secara kolektif dirujuk sebagai "Tujuan").

Pendedahan Kepada Pihak Ketiga

Jika dan apabila perlu, berkaitan dengan Tujuan di atas, Data Peribadi anda mungkin akan didedahkan dan/atau dipindahkan kepada pihak ketiga, termasuklah, tetapi tidak terhad kepada:

  1. kumpulan syarikat dan organisasi kami (termasuklah syarikat bersekutu dan anak syarikat kami, jika berkenaan);
  2. pihak sekutu kami;
  3. pekerja kami, ejen berdaftar, pembekal, syarikat penyedia perkhidmatan, kontraktor dan mana-mana orang atau pihak yang berurusan dengan kami;
  4. penasihat profesional kami (seperti pakar penasihat cukai, akauntan, juruaudit, peguam dan lain-lain pihak profesional yang berkenaan);
  5. jabatan dan pihak berkuasa kerajaan; dan/atau

Keselamatan Data Peribadi Anda

Pihak Kami Tidak Akan Bertanggungjawab

Di Aplikasi Telefon kami, mungkin akan ada pautan ke laman web lain, blog-blog, laman media social dan aplikasi pihak ketiga (“Laman Pihak Ketiga”). Adalah dimaklumkan bahawa kami tidak akan bertanggungjawab terhadap pemprosesan Data Peribadi di Laman Pihak Ketiga tersebut. Sekiranya anda memaut atau sebaliknya melawat Laman Pihak Ketiga tersebut, sila semak dasar privasi yang diposkan di Laman Pihak Ketiga tersebut.

MVALUE MOBILE APPS TERMS OF USE

Introduction

This terms & conditions of use (“Terms of Use”) is created, owned and managed by MVALUE TRADING SDN BHD (Company Registration No. 202101037019 (1437319-K) (“Company”).

This Terms of Use applies to all users and members (“Users”) of the Company’s mobile application known as MValue (“Mobile Apps”).

Please read the contents of this Terms of Use carefully as the downloading, installing, browsing and/or using of our Mobile Apps will be subject to this Terms of Use. The contents of this Terms of Use are as follows:

Clause 1: Ownership of the Mobile Apps

The Mobile Apps is wholly owned, managed and/or operated by the Company.

All of the contents, information, data, materials, promotions, pricing, pictures, intellectual property and/or logo whatsoever available and found on the Mobile Apps are fully owned, managed and/or operated by the Company at all times.

Clause 2: Full Consent & Acceptance

Users who have downloaded, installed, entered, browsed, used, registered, purchased, subscribed, interacted, communicated and/or viewed the Mobile Apps shall accept without limitation or qualification, all of the terms and conditions as stated in this Terms of Use herein below and shall automatically be bound by the Terms of Use upon downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps.

Further, it is impliedly and expressly deemed that this Terms of Use (of the Mobile Apps) has been fully read and agreed upon by all Users of the Mobile Apps whomsoever.

If any Users do not agree to follow and comply with the Terms of Use, kindly stop downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps immediately.

Clause 3: Legal Binding Effect

The Company reiterate that all Users’ conduct in downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps will always be subject to the Terms of Use which at all times remain valid, effective and binding on all Users.

It is hereby agreed that all Users are fully agreeable and consented to be fully bound by this Terms of Use.

The Mobile Apps shall be available for any interested member of public and Users to download via their mobile phone and/or whatsoever gadgets AND thereafter, the said Users will be able to browse, use, select, purchase and/or subscribe for various products, services, facilities, payments, items, goods, deals, offers, promotions and/or packages (“Products”) advertised, made-available and listed for sale and/or subscription on the Mobile Apps.

Clause 4: Contents of the Mobile Apps

The Company is the owner and operator of MValue convenience stores which have various outlets in Malaysia (“MValue Stores”).

The Mobile Apps shall contain certain products, services, facilities, payments, items, goods, deals, offers, promotions and/or packages that are available for purchase at the MValue Stores.

The Mobile Apps also contains certain Products from various suppliers, merchants, various qualified service provider and/or various vendors engaged by the Company (“Merchants”).

These Products are listed, advertised, made-available and offered to all users of our Mobile Apps for all users to browse, use, select, purchase and/or subscribe accordingly. Details, information and prices of the Products offered, listed, advertised and/or made-available on our Mobile Apps shall be as stated on our Mobile Apps.

All Users must read carefully and understand the respective Products before proceed to make any purchase, payment and/or subscription. In the event of any ambiguity, please contact the Company soonest possible.

At all times, the Company hereby will use its best endeavours to ensure that all description, contents, information and data relating to the Products and/or Merchants as listed, available and advertised on the Mobile Apps to be as accurate as possible without any element of misleading.

The sale and/or subscription of the Products listed, advertised and/or made available on the Mobile Apps will be executed through online whereby the Users will purchase and/or subscribe the Products using the Mobile Apps.

The Company shall attempt to ensure to always honour all sale and/or subscription of the Products as advertised, listed and/or made available on the Mobile Apps.

Take Notice that the Company has the absolute discretion to prohibit any part of the sales and/or subscriptions of any Products on the Mobile Apps if in the opinion of the Company that there is a chance or risk that a particular User could be providing false, fake, inaccurate, improper or incomplete personal details and/or payment details.

Clause 5: Prohibition, Limitation & Restrictions

TAKE NOTICE that all Users of the Mobile Apps cannot and are not allowed to duplicate, use, copy, distribute, publish and/or commercially exploit any information, data, materials, promotions, pricing, pictures, intellectual property and/or logo whatsoever available and found on the Mobile Apps for any personal, private or for whatsoever purposes unless with the prior written consent and/or approval of the Company. .

The Mobile Apps is designed for Users to transact with the Company to purchase, enquiry and/or subscribe the Products listed, advertised and/or made available on the Mobile Apps.

At all times, the Company shall (on best endeavour basis) always ensure that the Mobile Apps is legal and shall only be used for lawful purposes and in a manner, which does not violate the rights of, or restrict the use of the Mobile Apps by any User.

Such restriction shall include, but is not limited to, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, the transmission of obscene or offensive content or of defamatory, racially or ethnically objectionable material of any kind or disruption of normal flow of dialogue within the Mobile Apps.

Users are also warned not to commit any crime, fraud, hack, interrupt, corrupt, cause and/or distribute any malware, spyware, virus or any illegal bugs on the Mobile Apps.

The Company at all times reserves all rights and discretion to initiate any actions against any Users who violate this Terms of Use and the Mobile Apps (including, but not limited to, legal action and lodging of reports with the relevant authorities including the police).

Clause 6: Age 18 and Above

In any event, when any Users downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps, the User hereby confirm that he/she is over the age of 18 years and are legally eligible to enter into binding contract with the Company.

For Users under 18 years of age, the Company reiterate that the Users may only download, install, enter, browse, use, register, purchase, subscribe, interact, communicate, and/or view the Mobile Apps with the consent of their parent or guardian.

Otherwise, User below the age of 18 years old are warned to stop downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps immediately. Any breach of this by any individuals below the age of 18 years old shall not be under the responsibility or liability of the Company.

Clause 7: Display, Graphic, Contents, Descriptions and Details of the Products

All details, specifications, information, display, graphic, contents and/or descriptions of the Products listed, stated and advertised on the Mobile Apps are provided to us by various supplier, Merchants, brand owners and businesses.

Therefore, the Company has not independently verified and/or confirm such details, specifications, information, display, graphic, contents and/or descriptions of the Products.

All Users are encouraged to seek professional or expert advice and consultation in order to accurately verify the Products (including the details, specifications, information, display, graphic, contents and/or descriptions of the Products) advertised, listed and/or made available on the Mobile Apps. In addition, the Company also welcomes any enquiries from any Users on the Products advertised, listed and/or made available on the Mobile Apps.

All graphics, images and colours used on the Mobile Apps may varies depending on Users’ display monitor and screen quality and may not be accurately rendered.

Further, the Company do not warrant that the details, specifications, information, display, graphic, contents and/or descriptions of the Products available, advertised and/or listed on the Mobile Apps as 100% accurate, current or free from any errors.

In this regard, the Company shall have the right to correct any errors, inaccuracies or omissions at any time (as practicable to do so) without providing any prior notice to any Users or parties whomsoever.

Clause 8: Third Party Links & Sites

The Mobile Apps may contain link(s) to third-party sites and/or social media accounts and/or blogs whatsoever.

The Company shall not be responsible (whether directly or indirectly) for any content and security of those third-party sites and/or social media accounts and/or blogs whatsoever as it is NOT operated OR managed OR owned by the Company in any way (unless otherwise declared by the Company).

Those third-party link(s) may be provided solely for the Mobile Apps’ Users convenience and it does not in any way indicate, expressly or impliedly, any endorsement, authorisation or sponsorship by the Company (unless otherwise stated by the Company).

The use of the contents on those third-party links, mobile applications, websites, social media accounts and/or blogs whatsoever are at the Users’ own risk.

It is the User’s responsibility to take all protective measures to guard against viruses, malware, spyware or other destructive elements whatsoever on that third-party sites and/or social media accounts and/or blogs whatsoever.

The Company hereby exclude whatsoever liability it may have in regard to the third-party websites and/or social media accounts and/or blogs whatsoever.

Clause 9: Intellectual Property Rights

All intellectual property and intellectual property rights (including, without limitation, any copyright, trademarks, patents, design rights, invention, logo, design and all other forms of intellectual property rights) on the Mobile Apps are wholly owned and/or licensed to the Company (except those which are owned by various Merchants which Products are advertised, listed and/or made available on the Mobile Apps).

Therefore, in no way whether directly or indirectly that this Terms of Use permits or constitutes a transfer of any intellectual property rights to any Users or parties whomsoever howsoever. At all times, no Users or parties whomsoever shall be permitted or allowed to register or claim (or attempt to register or claim) any intellectual property rights on the Mobile Apps.

In the event that the Products listed, advertised and/or made available on the Mobile Apps is alleged to have infringed any intellectual property rights of any party or person, the Company shall stop selling, advertising and listing the said Products on the Mobile Apps and/or provide refunds to any Users who has purchased the infringed Products accordingly.

Clause 10: Indemnity

Each User of the Mobile Apps hereby agrees to indemnify the Company (and the Company’s officers, directors, agents, subsidiaries, employees, collaborators, merchants, third-party providers or whomsoever authorised by the Company) from all claims, demands, losses, liabilities, costs, expenses, obligations, responsibilities and/or damages (including legal fees) whatsoever arising out of the User’s breach of the Terms of Use herein (including misusing the Mobile Apps for whatsoever unauthorised and/or illegal purposes).

Clause 11: Security, Modification & Update

The Company shall always envisage to properly secure the Mobile Apps appropriately with the use of current security features and/or whatsoever appropriate antivirus, spyware, firewall and malware software available in Malaysia (as appropriate and applicable to do so). However, by this, it does not mean that the Company is giving any guarantee to any Users that the Mobile Apps is 100% free from any security issues or threats whatsoever.

The Company also reserves the right, at any time, without prior notice, to change, modify and/or update any features, information, data, materials, promotions, pricing, pictures, intellectual property and/or logo whatsoever available and found on the Mobile Apps.

The Company may terminate, change, suspend or discontinue any content, design, colour, logo, information or element of the Mobile Apps, including the availability of any features, security, links and/or references of the Mobile Apps at any time.

The Company may also impose limits, prohibitions and/or restrictions on certain features, services and access to certain parts and/or all of the Mobile Apps without any prior notice or liability.

The Company may also at any time suspend the operation of this Mobile Apps for support or maintenance work, in order to update the content or for any other reasons whatsoever.

Clause 12: User’s Mobile Security, Gadget Security & Account Security

All Users are reminded to always ensure that their mobile phones and/or whatever gadgets used are well secured and protected while downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps.

The Company reiterate that all Users should only download and install the Mobile Apps through verified google play or apple store function only. Further, all Users should tightly protect their respective account log in details and password at all times.

All Users hereby agree that in no way shall the Company be held liable (whether directly or indirectly) in the event of any lack of security protection and/or virus, spyware or malware infected mobile phone, computer and/or gadget issues faced by any Users when downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps.

Clause 13: Data Privacy Notice & Confidential Information

All Users of the Mobile Apps is subject to the terms of the Privacy Notice, as uploaded by the Company on the Mobile Apps.

All User’s must read, understand, agrees and consents to the contents of the Privacy Notice accordingly. In essence, the Company uphold all provisions of the Data Protection Act 2010 in regard to the management and handling of any personal data.

All personal data, information and documents concerning all Users shall be treated with upmost confidentiality by the Company. In exchange, all Users are also expected to do the same when it come to the data, information and documents of the Company, unless those data, information and documents are already available to the public or are allowed to be disclosed under the Malaysian laws.

Clause 14: Order, Purchase and/or Subscription of Products

Kindly read, check and review carefully each of the Products’ details, information, terms, descriptions, pricing, fees, delivery charges and/or other charges prior to making any order, purchase and/or subscription of the Products.

Please be reminded that once an order, purchase and/or subscription for the Products have been made or placed on the Mobile Apps, the order, purchase and/or subscription is deemed and regarded as CONFIRMED. No edits, changes and/or modifications shall be allowed or permitted unless otherwise stated on our Mobile Apps for the particular Products.

The Company shall have the right and discretion to impose a “Minimum Order Value” for the order, subscription and/or purchase made by Users. If the order, subscription and/or purchase is below the Minimum Order Value, then the Company is at liberty and entitled to impose a surcharge. The surcharge shall be as stated on the Mobile Apps and will be factored into the final price of the order, subscription and/or purchase.

Clause 18: Reward Points

As and when it is available, the Company may introduce certain loyalty point, reward point and/or bonus point system (“Reward Points”) to excite & enhance User’s usage and purchasing experience on the Mobile Apps.

The Reward Points shall be offered, earned by and provided to the Users for:

  1. each sale, purchase and/or subscription of the Products advertised, listed and/or made available on the Mobile Apps;
  2. for any successful referrals made by the User and thereafter, on whatsoever transactions performed by the newly referred person on the Mobile Apps; and/or
  3. according to the promotional activities and/or campaign available and announced on the Mobile Apps from time to time.

Further, all Users who has accumulated the Reward Points will be able to redeem certain privileges, benefits, discounts, vouchers, incentives, products and/or services on the Mobile Apps.

For the avoidance of doubt, the terms and conditions on the entitlements, awards and redemption of the Reward Points shall be as stated and announced by the Company on the Mobile Apps from time to time.

At any time, the Company has the absolute discretion and decision to amend or alter or make any changes to the entitlements, award and/or redemption of the Reward Points. Once the Reward Points are used or redeemed, no cancellation, alteration, changes and/or modification shall be made by the Users.

The Company has the absolute right and final decision to cancel any usage, withdrawal and/or redemption of the Reward Points in the event of any errors, mistakes and/or inaccuracies whatsoever.

Take Notice that the request for withdrawal, usage and/or redemption of Reward Points may take about 28 working days or so for it to be completed and processed by the Company.

Further, the Reward Points may have certain conditions, requirements, restrictions, limitations and/or expiry date as announced and/or stated on the Mobile Apps by the Company from time to time which all Users must abide and comply with it at all times.

Clause 19: Discount Voucher, Cash Back & Promotional Code

As available, from time to time, as an extra added benefit, incentives and/or promotion on the Mobile Apps, the Company may make available or provide certain discount vouchers, cash back incentives and/or promotional code to certain Users or for certain Products or upon purchasing certain Products on the Mobile Apps.

The Company reiterate that each discount voucher, cash back incentives or promotional codes may have certain specific usage requirements or terms and conditions or expiry dates or limitations which all Users must abide and comply.

These specific usage requirements or terms and conditions or expiry dates or limitation shall be as stated and published on the Mobile Apps and/or as communicated by the Company from time to time.

In no event shall the Company be held liable in the event of any non-compliance by any Users with the requirements or terms and conditions or expiry dates or limitations of those discount voucher, cash back incentives or promotional codes.

Please also be reminded that the Company reserves its rights and discretion to amend, change, stop, reject or refused any discount voucher, cash back incentives or promotional codes at any time without any prior notice to the Users or anyone.

Clause 20: Termination of Products, Merchants & Mobile Apps

At any time, all Users hereby agree that the Company hereby reserves all rights and discretion to terminate any Products, Merchants, advertisement, listing, offers, promotions, redemption, Reward Points, discount vouchers, cashback incentives, promotional code and any function of the Mobile Apps without providing any prior notice or reasons to any Users, party or person whomsoever.

Clause 21: Promotional Activities, Lucky Draw, Games and Live Streaming

As and when it is available, from time to time, at the sole and absolute discretion of the Company, the Company may conduct certain promotional activities, lucky draw, games and live streaming on the Mobile Apps.

The purpose of these activities is to enhance and boost promotional activities of the Mobile Apps.

It is hereby agreed and acknowledged that these games, lucky draw and live streaming are solely for promotional & marketing purposes and are not related to any investment scheme, betting, unauthorised online gaming and/or pyramid scheme whatsoever.

In regard to the promotional activities on the Mobile Apps, it will be announced on the Mobile Apps from time to time which may features certain deals, discounts, packages attractive prizes and/or Reward Points, as decided by the Company from time to time.

Details of these promotional activities will be as published by the Company on the Mobile Apps.

As for Lucky Draw and Games, these are for leisure purposes only and are held purely for marketing and promotional purposes only.

The respective requirements and terms for each lucky draw and games shall be as published on the Mobile Apps.

As for live streaming on the Mobile Apps, all Users to note that this may involve certain authorised personnel, celebrities, influencer or public figure to promote or endorse certain Products on the Mobile Apps.

On best endeavours basis, the Company will always try to ensure that the authorised personnel, celebrities, influencer or public figure involved in the live streaming will comply with all laws, regulations, limitations and rules in Malaysia and shall always provide accurate and true descriptions of the Products and promotions they are promoting.

In the event of any errors or inaccurate descriptions or statements made during the said live streaming, the Company hereby warrant that it will promptly (without undue delay) try to rectify the errors or inaccuracy statements made.

Clause 22: Users’ Interaction and Comments

From time to time, at sole decision of the Company, certain Users may be allowed to interact and make online comments on certain Products listed, advertised and/or made available on the Mobile Apps.

All Users hereby noted that their respective comments must be genuine, professional, ethical, polite, accurate, fair and honest. All comments submitted by the Users will be subject to review by the Company before it is being made available online. Kindly be reminded that the Company may refuse and/or reject comments made by any Users if the Company feels that those comments are offensive, inaccurate and/or may cause controversies.

Kindly note that the Company will not tolerate any unfair, hatred, vulgar, racist, discriminatory, offensive, sexual or sexist remarks from any Users. In such event, the Company has the absolute rights to immediately block, cancel, terminate, suspend or remove the said User from the Mobile Apps.

Further, the Company also reserves its rights and discretions to take any further action (including legal action and lodging reports with the relevant authorities) against the said User.

Clause 23: Error & Mistake by Users

The Company (including, but not limited to, the Company’s employees, representatives, merchants, retailers, suppliers and/or agents), Merchants, third-party providers or whomsoever authorised by the Company to be involved or provide certain services for the Mobile Apps shall not be responsible in any way (whether directly or indirectly) for any error, mistake, negligence, misuses, mis-purchase and/or any other acts of the Users when downloading, installing, entering, browsing, using, registering, purchasing, subscribing, interacting, communicating and/or viewing the Mobile Apps.

On a case-to-case basis, the Company may not be obliged to provide any refund, exchange and/or compensation whatsoever to any Users for any errors made or caused by the User.

Clause 24: Delivery & Shipping of Products

Details, pricing, fees, conditions and/or charges regarding the delivery, shipping and/or pick-up (as applicable) shall be as stated, detailed and/or written on the Mobile Apps for each of the Products. Therefore, all Users are reminded to carefully read, review and check the delivery, shipping and/or pick-up details for the respective Products.

Kindly refer to our Delivery, Shipping and Pick-Up Policy on the Mobile Apps for further details.

Clause 25: Transfer of Ownership of Products & Warranty Period

The title, ownership and risk of the Products shall pass to the Users at the time of delivery & shipping of the Product by the Company and/or Merchant or when the Products is being pick-up by the Users accordingly.

Any warranty period for the Products (if any) shall be honoured and managed by the Company and/or Merchants according to the information, details and descriptions provided on the Mobile Application for the particular Products.

Clause 26: Limitation of Liability

Any issues, problems, complications and/or losses whatsoever suffered by any Users on the Products purchased on the Mobile Apps must be communicated to the Company for the Company’s attention. The Company will then provide advice and/or instructions to the respective User on the solution etc.

In any circumstances, it is hereby agreed by the Users that the Company’s total liability to any Users shall be up to the total amount paid by the respective User for the Products purchased by the User on the Mobile Apps.v

For the avoidance of doubt, the Company shall not be responsible for:

  1. any indirect or consequential losses suffered by any Users;
  2. any deterioration of the value of the Products after the User purchased the Products from the Mobile Apps;
  3. any loss of profits, economic savings, anticipated savings or use whatsoever suffered by the User after purchasing the Products; and/or
  4. any loss of future profits, future economic savings, future anticipated savings or future use of the Products whatsoever after purchasing the Products.

Further, the User hereby agrees, warrants and undertakes to the Company that it will fully indemnify the Company from and against all claims, damages, liabilities, deficiencies, penalties, losses, costs (including legal costs on a solicitor and client basis) and expenses which the Company may suffer, incur or sustain as a result of or in consequence of or in relation to any inaccuracies, defaults, misrepresentations or breaches of any of this Terms of Use by the User.

Clause 27: Governing Laws

The Mobile Apps and this Terms of Use shall be based on the laws of Malaysia. Any disputes to the Mobile Apps and this Terms of Use shall be subject to the jurisdiction of the courts in Malaysia only.

Clause 28: Update, Revisions and Changes

From time to time, the Company reserves its rights and discretions to update, revise and/or change certain Section(s) of this Terms of Use to adapt with the functionality of the Mobile Apps, market demands, economic changes and/or promotional activities whatsoever.

All Users hereby agree to adhere and comply with whatsoever updates, revisions and/or changes implemented and effected by the Company.

Clause 29: Enquiries

The Company has procedures in place in order to receive and respond to enquiries, complaints and/or feedbacks about this Terms of Use, the Mobile Apps and/or Products. Any enquiries, complaints or feedbacks in relation to the Mobile Apps, Products or this Terms of Use should be made on the Mobile Apps or in writing to the Company as per the details shown below:

Clause 30: English Version to Always Prevail

In circumstances that this Terms of Use is translated to any other languages and there’s confusion, conflict, ambiguity, uncertainty and/or dispute on any of the sections or clauses herein, the Parties hereby agree that the English Version of this Terms of Use shall always prevail over any other languages’ version of this Terms of Use, as applicable.





PAYMENT, REFUND & CANCELLATION POLICY

Introduction

This payment, refund & cancellation policy (“Payment, Refund & Cancellation Policy”) is created, owned and managed by MVALUE TRADING SDN BHD (Company Registration No. 202101037019 (1437319-K) (“Company”).

This Payment, Refund & Cancellation Policy applies to all users and members (“Users”) of the Company’s mobile application known as MValue (“Mobile Apps”).

Please read the contents of this Payment, Refund & Cancellation Policy carefully as the order, subscription and/or purchase of any Products from our Mobile Apps will be subject to this Payment, Refund & Cancellation Policy. The contents of this Payment, Refund & Cancellation Policy are as follows:

Clause 1: Payment Amount Calculation

Payment is required before an order, subscription and/or purchase of Products on our Mobile Apps is classified as CONFIRMED.

All prices and amount for the Products selected as appeared on the Mobile Apps are in Ringgit Malaysia (RM) and are inclusive of the current applicable sales and services tax (SST), unless otherwise stated.

At the checkout process, the total prices for the order, subscription and/or purchase of the Products will be as displayed on the Mobile Apps (“Total Prices”).

The Total Prices as displayed on the Mobile Apps during checkout process shall include:

  1. any indirect or consequential losses suffered by any Users;
  2. all applicable service charges;
  3. all applicable delivery & shipping charges and fees;
  4. all applicable packaging and wrapping fees;
  5. all applicable handling fees;
  6. any minimum order charges (if applicable);
  7. any discounts, cashback, rebates, promotions, free gifts, rewards (as applicable); and/or
  8. any other relevant fees or charges.

Although the Company will always try to ensure that the Total Prices as displayed on the Mobile Apps are correct, precise & up-to-date, unfortunately errors may occur sometimes.

In such circumstances, the Company reserves all rights to correct, rectify and amend the Total Prices accordingly without any liability or compensation whatsoever to the Users.

Further, as appropriate to do so, the Company may also instruct cancellation, termination and/or refund of the payments, orders, subscriptions and/or purchases made with the incorrect Total Prices.

Clause 2: Mode of Payment

Users will be required to pay for the Total Prices via any of the following payment options which will be clearly displayed on the Mobile Apps during checkout process:

  1. online banking transfer;
  2. third-party payment gateway service provider;
  3. credit card and/or debit card;
  4. certain e-wallet facilities; and/or
  5. cash-on-delivery.

TAKE NOTICE that the above payment options are not exhaustive or conclusive and is always subject to changes from time to time at the Company’s sole and absolute discretion.

Kindly also note that certain payment options of the Mobile Apps may incur additional charges or fees. These additional charges or fees will be as stated on our Mobile Apps and shall be borne by the Users.

In any event, the Company shall exclude all liabilities and responsibilities for any rejection or decline of payment by any banks, credit card providers, e-wallet facilities provider and/or third-party payment gateway service provider.

Clause 3: Online Banking Payment

This payment option is only available for selected banks as decided and made available by the Company on the Mobile Apps from time to time (which is also subject to change from time to time).

During checkout, if the Users opt for payment by way of online bank payment, then there shall be a link which will direct the Users to the respective banking site for payment purposes.

Take Notice that these sites are managed and/or operated by the bank or a third-party provider which are beyond the control of the Company. Therefore, in the event of any dispute, problems or issues encountered by the Users on these sites, the User shall deal directly with the banks accordingly and the Company roles shall be limited to assisting the Users only.

Further, the Users also agree that the Company shall be indemnified and excluded from any liabilities or responsibilities whatsoever in regard to the payment made on sites that are beyond the control of the Company.

Clause 4: Third-Party Payment Gateway Service Provider

During checkout, if the Users opt for this payment option, there shall be a link which will direct the Users to the respective third-party payment gateway site for payment purposes.

This payment option shall be processed, handled and managed by a third-party payment gateway facilities provider, as engaged and appointed by the Company, from time to time.

Users will have to take note and agree to the terms & conditions as stated on the third-party payment gateway service provider site too.

The types of payment method available shall be as appeared on the third-party payment gateway service provider website (usually, it will be via credit card payment or bank account payment or certain e-wallet system etc.).

Each User hereby agrees that the Company does not collect any payment from the User. Instead, it is collected by a third-party payment gateway service provider.

Therefore, if there are any dispute, discrepancies, issues, problems, ambiguities and/or inaccuracies whatsoever in regard to the payments made for the Products, the Company shall assist the Users in communicating with the third-party payment gateway service provider and shall not in any event be held responsible to any part of the dispute, unless otherwise proven that it is due to the error and/or negligence of the Company.

Clause 5: Credit Card and/or Debit Card

Please take note that only certain type of credit card from certain banks may be allowed to perform payment transactions on the Mobile Apps (and this is subject to changes from time to time).

The Company shall be excluded from any liability or responsibility in the event of any payment failure which is not caused by the Company.

Clause 6: E-Wallet Facilities

As available, certain e-wallet payment facilities may be accepted on the Mobile Apps (and this is subject to changes from time to time).

The Company shall be excluded from any liability or responsibility in the event of any payment failure which is not caused by the Company.

Clause 7: Cash on Delivery

This payment method may be made available for selected Products only whereby User will have to pay in cash the amount to the Company’s delivery service provider, agent, courier services and/or rider during the delivery of the Products.

It is hereby agreed that the User must provide exact amount to the Company’s delivery service provider, agent, courier services and/or rider during the delivery of the Products.

Any non-payment or failure to pay the Total Price during the delivery shall cause the Company’s delivery service provider, agent, courier services and/or rider to reject or refuse to hand-over the Products ordered, subscribed and/or purchased to the User.

Clause 8: Payment Wallet

As and when it is available, the Company may introduce and make available “Payment Wallet” as one of the payment options available on the Mobile Apps.

Payment Wallet is a cashless transaction payment method and is only applicable for usage via the Mobile Apps only.

All Users of the Payment Wallet will be required to register on the Mobile Apps accordingly and provide all relevant personal details as requested and required accurately, correctly and precisely.

The Company shall always reserve the rights and discretion to perform further verification and checking on the Payment Wallet registration by the Users.

The Company will not in any way be responsible for any incomplete, improper, inaccurate, unverified or malicious registration of the Payment Wallet.

In order to top-up funds on the Payment Wallet, Users of the Mobile Apps will be able to do so via online transfer from banks, selected debit cards and/or credit cards (as announced by the Company from time to time).

In the event of any financial charges or fees imposed by any banks or cards providers used for the Payment Wallet purposes, it is agreed hereby that it will be fully borne by the Users and not the Company.

Clause 9: Maintenance of Payment Options

The Payment Options of the Mobile Apps is subject to maintenance and upgrading purposes from time to time whereby certain mode of payment of the Mobile Apps may be unavailable for a certain period (which will be announced and notified by the Company to the User from time to time on the Mobile Apps).

Clause 10: Refunds & Cancellation

Please be reminded that once an order, purchase and/or subscription for the Products have been made or placed on the Mobile Apps and payment has been made too, the order, purchase and/or subscription is deemed and regarded as CONFIRMED. No edits, changes and/or modifications shall be allowed or permitted unless otherwise stated on our Mobile Apps for the particular Products.

However, on certain exceptional cases, a refund & cancellation of the order, purchase and/or subscription shall be allowed to the User as follows:

  1. if the Product has issues, defects and not of merchantable quality;
  2. if there is a mistake/error/breach by the Company and/or Merchants whereby the Products delivered did not match the descriptions as stated on the Mobile Apps; and/or
  3. if the Products failed to be delivered to the User.

All refund & cancellation requests shall be submitted by the Users to the Company as soon as possible, in any event no later than twenty-four (24) hours after delivery of the Products, failing which, the Users hereby agree and acknowledge that its rights to request for refund & cancellation have lapsed and voided.

All refund & cancellation requests must be supported by clear and concrete proof, evidence and justifications, failing which, the Company has all rights and discretion not to allow any refund & cancellation.

The Company shall have all rights and discretions to also commence proper investigation on the refund & cancellation requests.

All decisions of the Company on the refund & cancellation request are full and final.

In the event of any ambiguity or uncertainty on the terms of the order, subscription and/or purchase of any Products on the Mobile Apps, all Users must promptly contact the Company as soon as possible and the representative of the Company will attempt to resolve all ambiguity and uncertainty soonest possible.

Clause 11: Cancellation by the Company

It is hereby agreed that the Company shall be entitled to cancel an order, subscription and/or purchase of the Products on the Mobile Apps and/or stop the delivery process on the following circumstances:

  1. if the Products are no longer available;
  2. if the Users failed to make full payment for the order, subscription and/or purchase;
  3. if the Products failed to be delivered to the User.
  4. if the Users did not follow the relevant terms, conditions, rules, policies and/or requirements as set out in the Mobile Apps;
  5. if the Users committed any crime or offence (such as using a fraudulent identification, using stolen credit card etc.); and/or
  6. any other circumstances which in the opinion of the Company may impose a risk to the Company and the Mobile Apps reputation.

In this regard, the User hereby agrees and confirms that any decision made by the Company shall be final and conclusive.

Clause 12: Investigation & Checking by the Company

On a case-to-case basis, the Company will also commence checking and investigation on certain Users.

On this occurrence, the affected User hereby agrees and confirms to give his/her full cooperation to the Company at all times.

In any event, all Users hereby agree that the Company shall always be entitled to reserve its rights, entitlements and discretions to initiate any actions (including legal action) against any User in the event of any breach of terms, conditions, rules, policies and/or requirements as set out in the Mobile Apps.

Clause 13: Governing Law

This Payment, Refund & Cancellation Policy shall be based on the laws of Malaysia. Any disputes to the Payment, Refund & Cancellation Policy shall be subject to the jurisdiction of the courts in Malaysia only.

DELIVERY, SHIPPING & PICK-UP POLICY

This delivery, shipping and pick-up policy (“Delivery Policy”) is created, owned and managed by MVALUE TRADING SDN BHD (Company Registration No. 202101037019 (1437319-K) (“Company”).

This Delivery Policy shall apply to all users and members (“Users”) of the Company’s owned mobile application called “MValue” (“Mobile Apps”), who has made order, purchase and/or subscription of various products, services, facilities, payments, items, goods, deals, offers, promotions and/or packages (“Products”) as advertised, made-available and listed for sale and/or subscription on the Mobile Apps.

The Products advertised, made-available and listed for order, sale and/or subscription on the Mobile Apps are mostly from various merchants of the Company (“Merchants”).

Therefore, please read the contents of this Delivery Policy carefully and thoroughly before you subscribe, purchase and/or order any Products from the Mobile Apps.

Take Notice that all orders, subscriptions and purchases on the Mobile Application will be subject to this Delivery Policy at all times. The contents of this Delivery Policy are as follows:

Clause 1: Delivery & Shipping Details

Prior to making any order or purchase on the Mobile Apps, all Users will be required to complete their registration as a member on the Mobile Application.

During the registration process, Users will provide and submit to the Company all particulars, information and details regarding their delivery and shipping (such as their delivery & shipping address, location on map, confirmation email address, corresponding address, contact number etc.).

Therefore, TAKE NOTICE THAT it is the Users full and sole responsibility to ensure that all of the delivery & shipping particulars provided to the Company are always true, accurate and correct.

In no circumstances shall the Company or the Merchants (or any of its delivery partners, delivery providers and/or delivery agents) of the Mobile Apps shall be held liable or responsible for any errors, mistakes, negligence, omissions and/or inaccuracy of those delivery & shipping information provided by the Users.

Clause 2: Delivery & Shipping Coverage

Prior to completing an order or purchase on the Mobile Application, there will be an indication as to whether the Users delivery address is within the delivery and/or shipping coverage of the Mobile Apps.

The Delivery & Shipping Coverage may subject to change from time to time, depending on availabilities of our delivery riders, partners, agents and/or providers as well as order volume on our Mobile Apps.

Clause 3: Delivery & Shipping Charges

Our delivery & shipping charges depend on various factors (such as date and time of delivery, location, weight and size of the Products and accessibility etc.) and are never fixed.

All delivery & shipping charges will be as stated on our Mobile Apps prior to completing any order or purchases of the Products. Therefore, Users are reminded to carefully review, check and agree to the delivery & shipping fees and charges as indicated on the Mobile Apps before completing an order or purchase.

Due to the fact that our delivery & shipping charges very much depend on the location of delivery, therefore it is crucial for the User to carefully check whether they have entered the correct delivery & shipping addresses and location prior to making and completing an order or purchase of the Products.

Clause 4: Delivery & Shipping Period

Delivery & Shipping Period for every order or purchase of Products will be as stated on the Mobile Apps. Take Notice that all delivery & shipping period indicated on our Mobile Apps is an “estimation” only and very much depend on the traffic & weather condition, volume of order, our delivery partner, agents, postage services, courier services, shipping providers and riders’ availability and management which are beyond our control. Nevertheless, we will always on best endeavor basis attempt to be punctual at most times.

Due to the fact that our delivery & shipping period is an “estimation” only, as soon as there is a delay, the Company will attempt to immediately notify the User on the latest update on the delivery & shipping period in order to minimize any unnecessary interruption to the User’s daily schedule.

Notification to the Users will be via the Mobile Apps and/or email, therefore, User is reminded to frequently check the delivery status of their order on the Mobile Apps and/or email provided to the Company accordingly.

In any event, it is hereby agreed by all Users that the Company shall not be held liable or responsible for any compensation or liability, so long as the Company has updated the delivery & shipping period changes on the Mobile Apps within reasonable period.

In the event of major delivery delays (which usually are due to reasons beyond the control of the Company), the representative of the Company will communicate with the affected Users and sort out any concerns, query and issues which the Users may have in regard to the major delivery delays.

Depending on a case-to-case basis, the Company may offer cancellation and/or refund, as appropriate, to be solely determined by the Company. Please refer to the Company’s Payment, Refund & Cancellation Policy accordingly.

Clause 5: Changes, Alteration and Cancellation

The Company do not allow and permit any changes, alteration and/or cancellation to any order, subscription and/or purchase once the order, subscription and/or purchase has been confirmed and reflected on the Mobile Apps unless it is due to the fault or error of the Company.

Therefore, it is crucial to always check all information and details regarding your order, subscription and/or purchase of the Products on our Mobile Apps prior to the order, subscription and/or purchase being confirmed. No refund and/or compensation whatsoever shall be made by the Company to you on those circumstances.

Instead, the Company shall be entitled to impose additional charge on the User for any second delivery and/or shipping attempt or if the User would like to make any amendments to the delivery & shipping details after an order, subscription and/or purchase has been made and placed on the Mobile Apps. However, this is subject always to the discretion and decisions of the Company solely and absolutely.

Clause 6: Cancellation by the Company

Kindly be informed that the Company shall have full rights and discretion to cancel an order, subscription and/or purchase on the Mobile Apps by any User on the following circumstances:

  1. If the Company suspect the order, subscription and/or purchase has an element of fraud, malice or crime etc.;
  2. If the Company did not received payment for the order, subscription and/or purchase;
  3. If the Products for the order or purchase is not available for reasons beyond the control of the Company, especially since these Products are supplied by various Merchants;
  4. If the Company notices any error or mistake on the order, subscription or purchase made;
  5. Incomplete delivery & shipping details; and/or
  6. Any other circumstances beyond the reasonable control of the Company.

In this regard, any cancellation by the Company shall not caused any liability to the Company and the Company will elect to cancel the order and issue refunds to the User accordingly.

Clause 7: Recipient Availability During Delivery

Please always ensure that there will be someone available to receive and/or collect the order and/or purchase from our delivery partner, agent, rider and/or provider.

Our delivery partner, agent, rider and/or provider will usually conduct simple verification on the recipient and you are advised to cooperate (or instruct your recipient to cooperate) on the verification process.

However, please note that this verification process is not a guarantee from the Company nor any acceptance of liability from the Company that our delivery & shipping process is free from any error or mistake.

Therefore, you are always advised to keep a look on the status of delivery on the Mobile Apps and should you notice any issues or ambiguity in regard to the delivery updates on our Mobile Apps, kindly contact the Company soonest possible.

TAKE NOTICE that if our delivery partner, agent, rider and/or provider is not able to enter the User’s location, address to deliver the order or purchase OR unable to deliver the order or purchase due to the unavailability of the Users or recipient, our delivery partner, agent, rider and/or provider may leave the Products outside the address, premise and/or location.

In these circumstances, User hereby agree to indemnify and exclude the Company (and the Company’s delivery partner, agent, rider and/or provider) from any liabilities or responsibilities whatsoever in regard to the Products delivered.

Clause 8: Self Pick-Up Option

Depending on the availability as stated on the Mobile Apps, certain Products can be self-collected or self-picked-up by the User at the designated MValue Convenience Stores.

Self-Pick-Up Option shall be as indicated on the Mobile Apps, include the pick-up date and time and pick-up location. Proof of purchase from the Mobile Apps is required prior to collecting the Products from the designated MValue Convenience Stores.

Depending on the self-pick-up location, time and date, the Company may impose certain charges and/or fees for this option. Any charges and/or fees to be imposed shall be as indicated on the Mobile Apps prior to completing the purchase.

TAKE NOTICE that in the event that the User did not or failed to self-pick-up the Products from the designated MValue Convenience Stores on the agreed pick-up date, time and location, it is hereby agreed that the Company shall be at liberty and entitled to terminate and/or cancel the order, subscription and/or purchase without any compensation or refund whatsoever to the User. The Company is also entitled to refuse collection of the Products thereafter.

Clause 9: Complaints and Issues

All complaints and issues in relation to the delivery must be raised and communicated to the Company soonest possible, in any event, no later than twenty-four (24) hours after the delivery of the order, subscription and/or purchase.

Take Notice that the Company may choose not to process, attend, investigate and/or accept any complaints lodge after twenty-four (24) hours of delivery of the order, subscription and/or purchase.

The Company will investigate all complaints and issues on good-faith basis. All decisions of the Company shall be full and final.

Clause 10: Passing of Risk

The Company shall not be held liable to the order, subscription and/or purchase after delivery & shipping have been made. If no complaints are lodge within twenty-four (24) hours of delivery and/or shipping of the order, subscription and/or purchase, it is deemed that the User has fully accepted the order, subscription and/or purchase without any issues or complaints.

Clause 11: Liability of the Company

The Company shall only be liable for:

  1. any major delay of delivery & shipping and failed to inform the User on the major delay;
  2. if the Products delivered or received are not of merchantable quality;
  3. if the Products delivered or received are faulty and defective; and/or
  4. failure to deliver the Products correctly according to the order, subscription and/or purchase made.

In the occurrence of the above, the Company may elect to provide a refund (in full or in part), at the sole and absolute discretion of the Company.

In any event, it is hereby agreed that the total liability of the Company to the User shall be limited and capped up to the price paid by the User to the Company for the purchase, subscription and/or order only.

Clause 10: Passing of Risk

The Company shall not be held liable to the order, subscription and/or purchase after delivery & shipping have been made. If no complaints are lodge within twenty-four (24) hours of delivery and/or shipping of the order, subscription and/or purchase, it is deemed that the User has fully accepted the order, subscription and/or purchase without any issues or complaints.

Clause 12: Exclusion of Liability of the Company

The Company cannot be liable for any failed delivery & shipping or if there is a delay to the delivery & shipping or if the order, subscription or purchase delivered has issues, problems or even gone missing that are caused by the following:

  1. the delivery partner, agent and/or provider is unable to enter the delivery location, premise or area (due to various reasons not attributed to the fault of the Company);
  2. delivery information inaccuracies or incompleteness;
  3. non-availability of recipient during delivery;
  4. natural disaster and/or accidents; and
  5. any other reasons beyond the control of the Company or the delivery partner, agents and/or provider (such as movement restriction order by the authorities etc).

Clause 13: Packing of the Products for Delivery

The Company will always try to properly, reasonably and securely packed each order and purchase of the Products on the Mobile Apps.

However, this does not mean that the Company is providing a guarantee to the Users that the packing of the Products will not cause any dent, damage and/or issues with the shipping and/or delivery of the Products.

Users hereby understands and agrees that shipping & delivery of the Products are managed and handled by the Company’s delivery partner, agents, postage services, courier services, shipping providers and riders’ which are beyond the control of the Company.

In the event of any issues or problems with the delivery & shipping, kindly reach out to us and we will attempt to resolve the issues or problems accordingly.

Clause 14: Enquiries and Contact

Clause 15: Governing Law

This Delivery Policy shall be based on the laws of Malaysia.

Any disputes to the Delivery Policy shall be subject to the jurisdiction of the courts in Malaysia only.

Clause 16: Update, Revisions and Changes

From time to time, the Company reserves its rights and discretions to update, revise and/or change certain Clause(s) of this Delivery Policy to adapt with the functionality of the Mobile Apps, market demands, economic changes and/or promotional activities whatsoever.

All Users hereby agree to adhere and comply with whatsoever updates, revisions and/or changes implemented and effected by the Company.

Clause 17: English Version to Always Prevail

In circumstances that this Delivery Policy is translated to any other languages and there’s confusion, conflict, ambiguity, uncertainty and/or dispute on any of the sections or clauses herein, the Parties hereby agree that the English Version of this Delivery Policy shall always prevail over any other languages’ version of this Delivery Policy, as applicable.
